For those of you who had a chance to join Wendy Weiss, Counsel for the New Jersey Board on CLE and I last Tuesday, June 22nd for our rules review, many providers received a “bombshell” type announcement – groupcasts or group viewings with a moderator would not be considered “live” credit for purposes of New Jersey CLE. This may be contrary to what many of us had been told previously.
In order to ensure that I understood the limits and credit types which we as a provider could offer, I asked for additional clarification from Wendy. Below is her response.
But to summarize: For live credit to be offered, the speaker must be in the same room as the participants. The only exception will be for attendees viewing the program from an overflow room in the same location as the live event (participants could walk into the live room with the speaker to interact and ask questions as any attendee in the same room with the speaker).
In all other situations, the speaker and attendees must be in the same room to be live credit. If a provider is offering a webcast to additional locations, even if a moderator is available to facilitate questions and discussion, the additional locations are offering an “alternative verifiable format” course.
I hope this clarification helps other providers and the New Jersey attorneys to whom we are offering credit. I believe this is an area that the Board will continue to review, especially if they receive feedback from New Jersey-barred attorneys who wish to have this policy changed. Gina.. please be advised that in NJ currently, a course is live if the instructor is in the room with the participants. if the course is given through teleconference, webcast, videoconference, simulcast, even if interactive and in real time, it is not considered live... it is considered alternative format. at this point, having someone in the alternative locations to answer additional questions to those in the alternative sites will not turn the course into a live event...
I understand this is a subject of great concern to law firms... this is the current policy of the Board.
